Alabama Cracks Down Harder On Illegal Immigration

Note to start with, the headline is very clear with the word "Illegal" when talking about Illegal aliens and immigration laws. If a reader doesn't understand the difference between immigrants here legally and those that have broken the laws of the country and entered illegally, many of which bringing children with them, then I would suggest a dictionary, not a blog post.

A couple stories about immigration laws have come to my attention today and how they cracked down on illegal aliens, those that abet them, hire them and house them. Now the Alabama Governor Robert Bentley has signed a new bill into law that will require public schools to verify citizenship status.

As with the the Arizona law now being fought in the courts with the Obama administration fighting against it, this Alabama law will also require police to detain someone they suspect of being in the country illegally if the person cannot produce proper documentation when stopped for any reason.

Furthermore, the law will allow the state to revoke or suspend a company's business license for employing someone that does not have legal status.

Recently in a 5-3 Supreme Court ruling it was reported that the Supreme Court backed the Legal Arizona Workers Act from 2007 which also allows the state to suspend or revoked the business license of company's hiring illegal aliens.

That was the Commerce v. Whiting case.

AmSpec reports the connection between that law and another Supreme Court case that has national implications for states cracking down on illegal immigration because the federal government refuses to enforce their own laws.

The case is called City of Hazleton v. Lozano.

Enter the Hazleton case. The city of Hazleton went farther than Arizona did. The city doesn't merely target business hiring; instead, it also suspends the rental licenses of landlords who knowingly and recklessly allow illegals to dwell in the landlords' property.

If one buys into the Left's spin, one would think that Whiting would have little bearing on Hazleton, because the ordinance in the latter is so much broader. Surely, according to this logic, the Supreme Court would reject Hazleton's law out of hand, just as the Third Circuit Court of Appeals had done last Sept. 9.

Think again. On Monday, the Supreme Court vacated the Third Circuit's decision against Hazleton's law, and remanded it back to the appeals court to reconsider specifically in light of the Whiting decision. In other words, Hazleton's law still stands against landlords who knowingly rent to immigrants, at least for now.

All these cases and laws have one specific commonality, they all deal with a state's right to protect itself from the reported 11.2 million illegal immigrants (as of March 2010) that have broken U.S. laws (yes that is a crime, making them criminals), especially with the federal government's inability or refusal to do so.

Supreme Court Backs AZ Law Punishing Employers For Hiring Illegals

In a 5-3 Supreme Court ruling, the high court has backed the Legal Arizona Workers Act from 2007, a law which punishes employers that hire illegal aliens by taking away the business licenses of companies that knowingly them.

This is one of the laws that the Obama administration opposes and is fighting against, claiming the state law tramples on federal authority.

The Supreme Court disagreed and ruled against that argument.

"Arizona has taken the route least likely to cause tension with federal law," wrote Chief Justice John Roberts. "It relies solely on the federal government's own determination of who is an unauthorized alien, and it requires Arizona employers to use the federal government's own system for checking employee status."

Roberts also said:

"Arizona went the extra mile in ensuring that its law tracks (the federal law's) provisions in all material aspects."

Those opposed to the Legal Arizona Workers Act claimed that federal law said states may not impose "civil or criminal sanctions" on employers, to which Roberts pointed out that another portion of that same law that opponents cited made clear that states were free to use their "licensing" laws to punish employers.

From the Ruling (Pages 5-6 of the 69 Page PDF)- Chamber of Commerce v. Whiting (09-115):

Federal immigration law expressly preempts “any State or local law imposing civil or criminal sanctions (other than through licensing and similar laws) upon those who employ . . . unauthorized aliens.” 8 U. S. C. §1324a(h)(2). A recently enacted Arizona statute—the Legal Arizona Workers Act—provides that the licenses of state employers that knowingly or intentionally employ unauthorized aliens may be, and in certain circumstances must be, suspended or revoked. The law also requires that all Arizona employers use a federal electronic verification system to confirm that the workers they employ are legally authorized workers. The question presented is whether federal immigration law preempts those provisions of Arizona law. Because we conclude that the State’s licensing provisions fall squarely within the federal statute’s savings clause and that the Arizona regulation does not otherwise conflict with federal law, we hold that the Arizona law is not preempted.

Majority Of Americans Not In Favor Of Obama’s Illegal Alien Nation

First the numbers, via Rasmussen:

A new Rasmussen Reports national telephone survey finds that 59% of Likely U.S. Voters favor a cutoff of federal funds to so-called sanctuary cities. Just 28% are opposed and 13% are not sure. (To see survey question wording, click here.)

However, only 29% of voters think Congress is even somewhat likely to agree to cut off funds to cities that provide sanctuary for illegal immigrants. Twice as many, 55% say Congress is unlikely to take such an action. Those figures include 9% who say Congress is Very Likely to act and 11% who say action is Not At All Likely. Seventeen percent (17%) are not sure.

Regardless of Congressional action, 58% of voters think the U.S. Justice Department should take legal action against cities that provide sanctuary for illegal immigrants. Twenty-six percent (26%) are opposed to having the Justice Department prosecute sanctuary cities and 16% are not sure. Those figures have changed little since last summer.

As Obama is in Texas harping on "the broken immigration system", polling shows that the majority of Americans want something done about Sanctuary cities, to the point of wanting them punished for refusing to obey the law.

What is the Obama administration doing to those that are flaunting their refusal?

Not a thing.

Liberal officials in both Illinois and San Francisco last week announced that they will no longer participate in the the Department of Homeland Security (DHS) program, preferring instead to allow criminal illegal aliens to roam the streets. While the White House has not responded to the immigration retreat, some in Congress want action. “The Obama administration has said that states and localities cannot opt out of Secure Communities, so the administration should make sure that all states comply with this mandatory program,” House Judiciary Committee Chairman Lamar Smith told me Monday.

Officially, DHS and ICE insist that they are strong supporters of the program. “Secure Communities is a critical part of transforming our approach to immigration enforcement by focusing our resources on those in our country illegally, who have also broken criminal laws,” said ICE Public Affairs Director Brian Hale. And while DHS Secretary Janet Napolitano has said that local states and cities do not have the right to opt out of the program, she has not done anything to enforce the requirement that lawbreaking illegals be held until ICE can take custody.

Unofficially, the Obama administration will not force states or cities to adhere to the federal program. Illinois and San Francisco can let their criminal illegals out of jail immediately after booking, without checking their fingerprints with the DHS database, and there are no consequences from Washington.

More from Rasmussen:

Just 17% support the creation of sanctuary cities in which some illegal immigrants are not turned over to federal immigration authorities unless they are convicted of committing a felony crime. Sixty-five percent (65%) oppose the establishment of sanctuary cities. Nearly one-in-five voters (18%) are undecided about them. This marks little change from October 2009.

A number of U.S. cities, ranging from big ones like Chicago, Los Angeles and New York City to smaller ones like Cambridge, Massachusetts; Austin, Texas and Albuquerque, New Mexico, have either declared themselves sanctuary cities or refuse to work with federal immigration authorities as police department policy.

Once again, Barack Obama is refusing to enforce the laws of the country when the majority of voters want those laws enforced, yet he dares give speeches talking about "the broken system" and suggests amnesty for illegals?

Enforce the laws on the books, punish those refusing to obey the laws instead of states like AZ that are trying to deal with the system breakdown and the Obama administration's incompetence and unwillingness to protect our borders and then and only then talk about "reform".

71 Percent Of Illegal Immigrants Receiving Welfare

The Center for Immigration Studies has released an in-depth report on the use of welfare programs provided by the U.S. to immigrants living in the country.

Bypassing the number of immigrants living in the United States legally, although those numbers are far higher than native born Americans, I searched the report directly for the welfare use by those in the country illegally and the report indicates that 71 percent of illegal immigrants are receiving welfare benefits.

Table 6 reports welfare use based on the legal status of the household head. The estimates show that 51.8 percent of households with children headed by legal immigrants used at least one major welfare program in 2009. For households with children headed by an illegal immigrant, 71 percent are estimated to use at least one program.

Anyone surprised that California leads the chart?

Overall, households with children headed by legal and illegal immigrants have higher use rates than their native-born counterparts in most states. However illegal immigrants across the county tend to have very low use rates for cash assistance programs. On the other hand, households with children headed by illegal immigrants tend to have much higher use rates for food assistance and Medicaid than natives. For legal immigrant households, use of cash assistance is more varied, but in general it tends to be higher than for natives. Use of food assistance and Medicaid for legal immigrant households tends to be significantly higher than for natives in almost every state.

They also include a dose of reality for those that continue to push policy that would give illegal immigrants any type of amnesty.

Illegal Immigrants. If welfare costs are to be avoided for illegal immigrants, then enforcement of the law and encouraging them to return to their home countries would make the most sense. Given the low educational attainment of so many illegal immigrants, allowing them to stay in the country means that welfare costs will remain high as well. Legalizing illegal immigrants would likely be the most costly policy option. Research indicates that half or more of illegal immigrants have not graduated high school and another 25 to 30 percent have only a high school education. Less-educated immigrants in the country legally have very high welfare use rates. Since legalization would in effect create millions of new less-educated legal immigrants, it seems clear that use of welfare programs would rise accordingly.

Of course, any amnesty would likely be accompanied by some restrictions on welfare for amnesty beneficiaries. However, these restrictions would almost certainly be limited in time; moreover they would not apply once a legalized immigrant becomes a citizen. Most importantly, any limitation on welfare use would have no impact on the eligibility of immigrants’ U.S.-born children. As we have seen, the presence of U.S.-born children has enormous implications for welfare use among immigrant households. Those that support legalization have to at least acknowledge the low education levels of illegal immigrants and what it means for use of the welfare system.

An Illegal Alien IS An Illegal Alien, Not An 'Undocumented Immigrant'

TPM reports that Fox News host Megyn Kelly compares calling an Illegal Alien an "Undocumented immigrant" to changing the word rapist to "non-consensual sex partners".

She is right. It is not the job of journalists to refrain from using an accurate descriptor because a small segment of the population doesn't like the term.

"You could say that a burglar is an unauthorized visitor. You know, you could say that a rapist is a non-consensual sex partner which, obviously, would be considered offensive to the victims of those crimes," Kelly said. "So how far could you take this?"

"What if there was a push by the criminal defense... bar to re-brand the use of the word rapist to nonconsensual sex partner?" Kelly asks her guest. Jehmu Greene, the former president of the Women's Media Center, said that was like comparing "apples and oranges."

Kelly also expressed frustration over the politically correct language dominating American culture.

Dictionary.com- Illegal Alien:

–noun
1. a foreigner who has entered or resides in a country unlawfully or without the country's authorization.

2. a foreigner who enters the U.S. without an entry or immigrant visa, esp. a person who crosses the border by avoiding inspection or who overstays the period of time allowed as a visitor, tourist, or businessperson.

Illegal aliens are not just undocumented, they are here illegally and changing the descriptors does not make that any less true.

Napolitano Blows Off Dead Patrol Border Agent's Family's Concerns

The audacity and arrogance of Homeland Security Secretary Janet Napolitano is astounding when she not only blows off the concerns of the recently murdered Border Patrol Agent Brian Terry, but "scolds" reporters for daring to confront her with those concerns of his father, mother and stepmother.

The family of agent Brian Terry had complained that Napolitano had offered them "empty words" when she called to express her condolences. Terry's father, Kent Terry, in an interview with ABC affiliate KGUN, said he told Napolitano to "wake your man up in the White House," to which she replied that he's done more in two years than any president.

Had the Obama administration put as much money and effort into placing more people on the borders to secure them and less on his desire to pass the amnesty DREAM Act, perhaps Agent Terry's family would not be mourning.

After being told the concerns came from his father, mother and stepmother, she continued: "Listen, we are here today, the commissioner is here today, the chief of the Border Patrol is here today and we are here and his comrades are here with the family, who said other things to me by the way, so I really don't think it appropriate for the media to try to pick this as a fight," she said. "This is a moment to remember a fallen agent."

So, when reporters dare question Napolitano, quoting family members themselves, she accuses the media of picking a fight? She should remember that fallen agent's family are the ones confronting her via the media. Then explain why more is not being done to secure the border before anything else, especially trying to push Congress to offer amnesty to those here illegally.

Terry's death falls right on the shoulders of Obama, Napolitano and Congress for not assuring more bodies on the border to secure it.

Cloture On DREAM Act Fails In The Senate 55-41

The Senate vote for cloture on the DREAM Act failed today with a vote of 55 to 41. Harry Reid needed 60 votes to invoke cloture. (Will supply roll call when it becomes available) ROLL CALL will be listed at this URL in approximately one hour)

Harry Reid filed for cloture, late Thursday night after pulling the omnibus spending bill, on DADT repeal and the DREAM Act, both pieces of legislation which both passed the Democratically controlled House of Representatives, and set the vote for both for today.

It is officially called The Development, Relief and Education for Alien Minors Act, yet the age cap is 29 years old and would give amnesty to individuals that were brought into the United States illegally if they meet certain conditions, such as;

Graduating from high school or receiving a GED;
Has been determined to be a person of “good moral character,” as determined by the Department of Homeland Security, from the date the individual initially entered the U.S.;
Submits biometric information;
Registers for the Selective Service;
Undergoes security and law-enforcement background checks and a medical examination.

2nd PRIORITY: Pound These Senators Up For Re-Election in 2012 Who Are Leaning YES on Amnesty

There is no logical political reason for these Senators to vote YES on amnesty . . . if the people of their states know what they are doing. All three of these have good tendencies in our direction on amnesty in the past. But they are acting like this amnesty is somehow different.

Your job with these Senators is to persuade their staffs that voting for an amnesty without any enforcement will definitely be a key issue in the 2012 elections during what all experts predict will be continuing high unemployment for U.S. workers.

Democrats Can Say Goodbye To DREAM Act In Lame Duck Session

Harry Reid and far left Democratic politicians are planning to schedule a vote on one or all of the five different versions of DREAM Act that have been floated during the lame duck session of Congress and the GOP is standing firm against pushing through the rest of the Democratic agenda before newly elected Senators are seated and the House turns over control to the GOP in January after voters swamped the polls and stripped control from Nancy Pelosi and Democrats.

It is not only the Senate GOP that is refusing to cooperate with Harry Reid in the Senate though, centrist Democrats and Democrats who are up for reelection are not exactly thrilled with jumping off the cliff as Reid would like them to.

Even as Democrats in both chambers prepare to consider the measure this week, Republicans and centrist Democrats are already lining up to shoot it down.

The climb is particularly steep in the Senate, where Republicans will filibuster the hot-button bill, and even former sponsors now stand in opposition.

Sen. Orrin Hatch, for instance, was the lead sponsor of the original DREAM Act when it emerged nine years ago. But already facing pressure from conservatives surrounding his 2012 reelection bid, the six-term Utah Republican is "sprinting to the right" away from the proposal, according to Frank Sharry, executive director of America's Voice, an advocacy group lobbying for the bill.

"He's not on any of our 'get' lists," Sharry said.

Hatch spokeswoman Antonia Ferrier declined to comment Friday on whether Hatch supports the underlying policy. She said Hatch's opposition — at least in the near term — stems from the recent vow among Senate Republicans to deny everything that hits the floor before the Bush tax cuts and government funding issues are settled.

"Everything's a 'no' until the tax issue is resolved," Ferrier said.

Harry Reid already knows all of this as the GOP penned a letter and sent it to him making it very clear that until the Tax issue is dealt with, the issue ranking the very top of the list for Americans, the GOP will filibuster and stop anything else from the Democratic last minute to-do list.

For that reason, we write to inform you that we will not agree to invoke cloture on the motion to proceed to any legislative item until the Senate has acted to fund the government and we have prevented the tax increase that is currently awaiting all American taxpayers. With little time left in this Congressional session, legislative scheduling should be focused on these critical priorities. While there are other items that might ultimately be worthy of the Senate's attention, we cannot agree to prioritize any matters above the critical issues of funding the government and preventing a job-killing tax hike.

To top matters off, we now see that Reid is also going to try to pass one last Omnibus bill, by shoveling 100+ other bills into one large bill to try to get his socialist, far left liberal agenda through at the last minute before the 5 addition GOP Senators are seated in January and the Republicans take control of the House.

Democratic efforts to push through more than 100 public lands and water bills in the lame duck session are reaching a fever pitch, with the recognition this is the last chance many of them have to become law.

Voters got sick of Reid/Pelosi/Obama doing that over the last two years and the Democrats are still trying to play the same game as they did before the elections, showing that they didn't learn a thing from the "shellacking" (Obama's word) that they took on November 2, 2010.

Americans and legal residents who have been battling against Democrats trying to provide amnesty to illegal immigrants have been pounding the phones letting their elected Representatives and Senators know it would be political suicide to jam through the DREAM Act during the lame duck session of Congress (after elections before the newly elected members are seated) and to that end, below is a long list of numbers to call and contact forms to fill out.

'Shaken' Democratic Senators Better Worry About DREAM Act And Lame Duck Session

The other day I wrote about how Barack Obama and the Democratically controlled Senate we planning to try to jam the DREAM Act through during the lame duck session of Congress (after elections but before newly elected politicians take their seats).

I also listed the 21 Democratic Senators that are up for reelection in 2012, with contact information to email and/or call them to make sure they understand that we will remember in 2012 if they deliberately try to thwart the will of the people who voted an overwhelming victory in the midterms for the GOP.

Today The Politico writes that Senators are shaken and already worried about 2012.. as well they should be and their first test is coming up.

The 2010 campaign has so rattled senators up for reelection in 2012 that they’re already moving quickly to figure out how to survive.

First lesson they should have learned, in order to "survive" is to not go up against the American voters who have shown very clearly that they can and will remember being betrayed by politicians that are supposed to represent them even against the politician's own party.

Will they help Harry Reid and Barack Obama thwart the will of the people by helping them shove the DREAM Act down American's throats before newly elected Senators and Representatives have a chance to take their seats?

Pew Research:

According to an analysis of U.S. Census Bureau data by the Pew Hispanic Center, an estimated 340,000 of the 4.3 million babies born in the U.S. in 2008 were the offspring of unauthorized immigrants. This means that while a little more than 4% of the U.S. adult population is composed of unauthorized immigrants, their children make up 8% of newborn population. Additionally, 7% of the overall child population (those younger than age 18) in the U.S. are the children of unauthorized immigrants.
